End-User License Agreement (EULA)

Agreement

This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and nine.is LLC ("The Nine," "we," "us," or "our") for the use of The Nine Financial Dashboard application ("the App").

By connecting your QuickBooks Online account to the App, you agree to be bound by the terms of this Agreement.

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your internal business purposes, subject to the terms of this Agreement.

QuickBooks Integration

The App integrates with Intuit QuickBooks Online to access your financial data. By using the App, you:

  • Authorize the App to access your QuickBooks Online data as described in our Privacy Policy.
  • Acknowledge that you have the authority to grant such access for the connected QuickBooks account.
  • Understand that the App uses Intuit's OAuth 2.0 protocol for secure authentication.

Permitted Use

You may use the App to:

  • View and analyze financial data from your connected QuickBooks account.
  • Generate reports, projections, and financial analyses for your business.

Restrictions

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to reverse engineer, decompile, or disassemble the App.
  • Share your access credentials or allow unauthorized users to access the App.
  • Use the App to access QuickBooks accounts for which you do not have authorization.
  • Redistribute, sublicense, or resell access to the App.

Data Accuracy

The App presents financial data as provided by QuickBooks Online. While we strive for accuracy, we do not guarantee that reports, projections, or analyses generated by the App are error-free. Financial projections are estimates and should not be considered financial advice. You are responsible for verifying data and consulting qualified professionals for financial decisions.

Intellectual Property

The App, including its design, features, and code, is the intellectual property of nine.is LLC. This Agreement does not transfer any ownership rights to you.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, nine.is LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS.

Termination

We may terminate or suspend your access to the App at any time, with or without cause. You may terminate this Agreement by disconnecting the App from your QuickBooks account and ceasing use.

Upon termination, all licenses granted to you under this Agreement will immediately cease.

Changes to This Agreement

We reserve the right to modify this Agreement at any time. Continued use of the App after changes constitutes acceptance of the modified terms.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions.
